FLCAN Celebrates Major Legal Victory for Patient Rights and Gun Ownership in Florida
Melbourne, FL — In a landmark ruling, Florida medical marijuana patients have secured a significant legal victory in federal court today, affirming their right to own and purchase firearms without being discriminated against for their legal use of medical marijuana. The case, Vera Cooper et al. v. Attorney General of the United States et al. (Docket No. 22-13893, a/k/a Cooper v. Garland), challenged federal law that prohibits unlawful drug users from possessing or purchasing firearms, asserting that such restrictions are unconstitutional as applied to medical marijuana patients.
“This is a monumental win for medical marijuana patients, who have long been caught in the crossfire of outdated federal policies. This decision sends a clear message that medical marijuana use should not strip away fundamental rights,” said Jodi James, President of the Florida Cannabis Action Network (FLCAN).
